After the very hard talk within the Mumbai High Court, the NMMC has been directed to seal the entire building at sec 30, Vashi. The NMMC was forced to seal the Micro Technologies building at Sector 30, Vashi for the third time part of which was being used by the contractor of the building M/s Haware Builders. This after the Mumbai High Court came down heavily on NMMC and specifically DMC Encroachment Amrish Patnigire. It may be recalled that NMMC had sealed the Micro Tech premises on November 2, 2007. Later when the case went to court, the high court had ordered the commissioner to hold a personal hearing with micro tech and decide the future course of action. NMMC then granted three weeks time to Micro Technologies for procuring OC. But even after this MT was not granted OC. In its clarification to the High Court for not granting OC to Micro Technologies, the NMMC has brought to light that the contractor has made provision of two car lifts, no parking space has been provided as sanctioned in the original plan, construction has been carried out in the stilt, which is required to be open and lack of fire NOC. On its part Micro Technology had explained that since a session’s court had already ordered a status quo, they could not re-structure the illegal constructions and violations. But a case took a turn when it came to the attention of the Mumbai High Court that despite DMC Amrish Patnigire giving an affidavit to the High Court that the entire building was sealed, part of it was de-sealed for the contractor Haware builders by NMMC itself on January . And it is here that the court seeks explanation as to why DMC Patnigire should not be punished for lying under oath.
