SUPREME COURT REFUSES TO STAY LAND ACQUISITION IN MUKESH AMBANI’S RAIGAD SPECIAL ECONOMIC ZONE

sezThe Supreme Court refused to entertain Mukesh Ambani-promoted Mumbai Special Economic Zone (MSEZ)’s plea for staying the land acquisition process for its project in Raigad. A bench of judges, while adjourning the matter till June 5, gave liberty to the ministry of commerce and industry, the Maharashtra government and others to file replies in the meantime. Senior counsel Shanti Bhushan, appearing for the MSEZ, sought the stay on the land acquisition proceedings initiated by notifications under Sections 4 and 6 on the ground that if the acquisition was not completed by June 8, the entire process would lapse under the Land Acquisition Act, 1894. Mumbai SEZ Ltd and its authorised representative Dilipkumar Vitthaldas Dherai also sought a direction to the state government to expedite the land acquisition process for setting up the SEZ in Raigad. MSEZ said that if the final consent award is not made before June 8, the process would lapse in line with the Act and “its rights would be effectively and conclusively lost”. However the Supreme Court refused to entertain Mukesh Ambani-promoted Mumbai Special Economic Zone’s plea for staying the land acquisition process for this project in Raigad.
